Terms of Service

Overview

 

Here at RVP we like to keep things simple so you will not find terms and conditions full of legalese that neither of us will understand. We do however want to ensure that we have a clear understanding of what we will do for you and what we will do if something does go wrong.

 

Should you accept a proposal from us this will be done by paying a deposit (usually 40%) and giving us notice by email that you accept our quote and wish for us to produce some amazing video for you.

 

Once this is accepted, we will produce for you the best results possible. We ensure this by offering our 100% Satisfaction Guarantee. We will adhere to the agreed proposal and will send you a first version of your video. At this point you can suggest edits that you feel are required. Once these are complete, we will send you the final video.

 

This video will be watermarked with our logo.

 

If you are happy with the final edit, you simply let us know, settle your balance, and you will receive your video the same day. This is usually done by us sending you a link from which you can download the video as many times as required.

If you are unhappy with the video for any reason within our control, we will refund you your deposit with no hard feelings. This can take up to 7 days to process.

 

What do both parties agree to do?

 

As our client, you confirm you have the authorisation and ability to enter into this contract on behalf of your company or organization. You agree to provide us with everything that we need to complete the project, including but not limited to, text, images and other information as requested, and in the format required.

 

You agree to review our work, provide feedback for any required edits and sign-off approval in a timely manner. Deadlines work both ways and you will also be bound by any dates that we set together.

 

Any information you share with us will be treated as confidential at all times.

 

We will carry out our services in a friendly, professional manner and will do so in a timely fashion. We will not however be held responsible for not hitting any deadlines if you have been late at any stage in supplying information or materials we required. We will also not be held responsible if you have not approved or signed off our work on-time at any stage.

 

Video Production

 

We will meet with you to discuss and create the concept for your video. We will discuss any motion graphics that need to be included as well as whether or not subtitles are necessary.

 

From this meeting we will issue you with a proposal which will include designs where necessary. All the information we need to create your video will need to be shared with us prior to the first day of filming. Changes or additions made after the first day of filming may result in extra charges. Although this is unlikely to happen, if it does we may need to re-quote for your project.

 

Written Content

All written content is to be provided by you and as such we will not be responsible for any spelling or grammatical errors unless we agreed to do so in the original proposal. Please make sure that you check for any errors when you receive the first version of your video. Any errors picked up after this stage may result in extra charges.

 

Stock Footage or Photography

 

If any stock photography or footage needs to be used will be chargeable to you at the same cost we have to pay. Although we are happy to source what you require it is also a good idea if you look yourselves to help us understand exactly what it is you are looking for. Any stock footage or photography we choose can be changed out by request following you receiving the first edit.

 

Changes and revisions

 

As stated, we generally offer a first edit, from which you can request the changes you feel are necessary. If more amendment rounds are necessary due to the project being large or complex this can be discussed in our meeting.

 

We are happy to discuss these changes over the phone but then require you to confirm all changes in writing. This ensures we do what is asked of us and you end up with the video you desire.

Copyrights

You guarantee to us that any elements of text, graphics, photos, videos, designs, trademarks, or other artwork that you provide us for inclusion in the web site or video production are either owned by you, or that you have permission to use them.

 

Legal stuff

If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

 

When we receive your final payment, copyright is automatically assigned as follows:

You own the graphics and other visual elements that we create for you for this project. We will give you a copy of all final edited files and you should store them really safely as we are not required to keep them or provide any native source files that we used in making them, we do our best to hold on to files for as long as possible after the completion of a project but cannot provide any guarantees after the agreed delivery date.

 

Please make us aware before a project begins if you require all raw footage and we will add the appropriate storage costs to our quotation.

 

You also own text content, photographs and other data you provided, unless someone else owns them (copyright release required.)

 

We own the PRODUCTION and license it to the CLIENT for use in perpetuity in its finished form. Any alterations or edits to the finished video must be agreed in writing, and doing so without this permission nullifies the licence agreement.

 

We love to show off our work and share what we have learned with other people, so we also reserve the right to display and link to your completed project as part of our portfolio and to write about the project on web sites, in magazine articles and in blogs about video production (unless otherwise specified in our correspondence).

 

Payments

 

As stated above we take a deposit upon you accepting our proposal which requires payment prior to us commencing any works. To enable this to be paid promptly we will send an invoice alongside the proposal. When we have delivered the final video with the watermark this will also be accompanied by our invoice for the balance. Payment of the balance will trigger us sending the final video without the watermark.

 

If you would like to discuss alternative payment times or dates, we can discuss that in our initial meeting.

 

Any discounts discussed at our initial meeting will only apply if payments are made in a timely fashion.

 

This contract is not transferable and becomes void upon completion of the final project. If this contract is terminated by the client for any reason other than non-performance by R V Productions Ltd this will result in full payment of the services provided to the date of termination.

This contract stays in place and need not be renewed.
